Jarrow Sends Strongly Worded Letter to NPA

Jarrow L. Rogovin, founder and president of Jarrow Formulas, Inc., has sent the Natural Products Association (NPA) Board of Directors a strongly worded request that Dr. Daniel Fabricant answer for his many negative comments and activities with the mainstream media during his three-year tenure at the FDA as Director of Dietary Supplement Programs.

“Now that the NPA has rehired Dr. Fabricant, this time as Executive Director, I am requesting that the NPA hold Dr. Fabricant accountable for the many disparaging remarks he made about the Dietary Supplement Industry,” says Mr. Rogovin.  “He trashed the industry maliciously for three years from his position at the FDA.  His remarks repeatedly condemned the industry as a whole, were often threatening, and usually lacked accurate context and were not backed by specific facts.  In a short period of time he claimed that 50% of the industry was, quote, out of compliance, unquote, and then shortly later 70%.  He never defined out of compliance, the seriousness of it or the basis for it.  He called the entire industry, quote, downright scary, unquote, and that the industry was, quote, failing on its face, unquote.  There were reports in the NY Times, Chicago Tribune, and USA Today containing misleading half-truths if not outright untruths.

Then there was the truly malicious NBC Dateline episode.  It was so bad it should have gotten the NBC Dateline segment producer and reporter fired along with Fabricant.  They took a four to six year old incident, made it seem like it was last month, and covered up for the FDA’s own failure to investigate, much less prosecute.   Fabricant himself staged a phony interview with him at a messy cubicle work station instead of his office, pleading poverty and lack of funds and covered up for the FDA’s failure to bring criminal charges against the lab for falsifying its reports as merely a lack of resources to do a “Good Laboratory Practices” audit.  So far he’s gotten away with all of this and it’s a disgrace.  This industry should ask itself, “Why is Dr. Fabricant no longer at the FDA?”

Jarrow served a 90-item FOIA on the FDA about Dr. Fabricant’s statements and actions six weeks before his resignation.  By hiring him back, Jarrow states that the NPA is more than tacitly agreeing with these attacks and statements.  “It is more than giving credence:  It is ratification.  It will come back to haunt.”

When the FDA first hired Dr. Daniel Fabricant as its new Director of Dietary Supplement Programs, Mr. Rogovin wrote FDA Commissioner Margaret Hamburg a 14-page letter criticizing the hiring of a top trade association executive as unethical and a conflict of interest for both the agency and the employee.

“How is any NPA member supposed to feel comfortable about strategizing with Dr. Fabricant over FDA-related issues now that he has boomeranged from NPA to FDA and back to NPA?  Will he simply bark – as he did before – ‘JUST COMPLY!  HOW DARE YOU QUESTION?’  There are too many unanswered questions with the industry having been aggressively, relentlessly and seriously slandered.  The question now is whether the NPA is going to seek answers and report them to the rest of its membership and the industry?  Or are we just children who don’t and shouldn’t have to know?  Who is this new Dr. Daniel Fabricant, anyway?  And what, exactly, are the standards and reasons of NPA’s board?  Last, NPA’s board should be comprised of members who are not also members of other boards.  Frankly, who is really setting NPA’s agenda anymore?”

This is not the first time Mr. Rogovin has been critical of the NPA.  He opposed its attempt to promote its “NNFA GMP” and then “NPA GMP” logo as being coercive co-branding and misleading.  He also publicly chastised the organization for remaining in Newport Beach, California for too long, instead of moving to Washington, D.C., which it eventually did.  Jarrow Formulas ultimately did not renew its membership in the NPA.  Mr. Rogovin shortly later founded the International Probiotic Association (IPA) and is a member of its Board of Directors.  The IPA’s World Congress will be held in Athens, Greece from May 9, 2014 – May 11, 2014 and will host almost two hundred executives and scientists and present over 20 scientific papers.
